CLIENT TERMS 8: CONDITIONS

This agreement is made to the client.

Engaged in Naked, topless and lingerie/outfit domestic cleaning Service.

AND The naked cleaning company exclusive limited.

Office 6, The Loft, Sutton Harbour, Plymouth, PL4—0DN.

(Hereinafter referred to as TNCC”).

Agreement for services 1. The TNCC wishes to engage the client a naked, topless and lingerie/outfit domestic cleaning service to our clients. 2. And the cleaner wishes to provide the above services to the TNCC clients.

Now therefore the parties hereto agree as follows:

Engagement

1.1 TNCC agrees to engage the cleaner to provide services to the TNCC’S clients upon and subject to the terms and conditions and DBS checks that will need to be carried out hereinafter set forth. 1.2 Cleaner is paid on arrival at the client’s property and must receive payment before carrying out the cleaning service. If client does not settle payment before they must not carry out works and leave property and contact TNCC. 1.3 1.3 TNCC has a very strict over 25 years and above age limit to be able to register as a ciient/cleaner.

1.4 The Client address used for registration is the ONLY address to which Cleaners will attend. Term

2.1 The term of the client’s engagement shall commence on a date this agreement is accepted. And to be renewed on a yearly basis at £89.99. Either party may terminate this agreement by providing the other party with written notification at least 14 days, provided that the TNCC may terminate the agreement at anytime and without notice for any breach of our legal clauses within this agreement.

Duties and Responsibilities. 3.1 Cleaner agrees to perform work for the TNCC on the terms & conditions set forth in this agreement and agrees to all necessary time and attention to the performance of the duties specified in this agreement.

3.2 The TNCC maybe required to carry out the following light duties: Vacuuming, general tidying, making beds, washing/drying up, polishing, cleaning of bathrooms, sweeping/mopping floors, dusting and cleaning of internal windows (not to clean at any height, feet must always remain on floor).

3.3 The TNCC shall not carry out any of the below service: cleaning of ovens, emptying bins, cleaning of any other areas that pose any kind of risk to the cleaner’s health & safety. Unblocking drains, services that require the use of strong chemicals, end of tenancy services, deep cleans or excessive lifting of heavy items and any other heavy or risky task that may be considered so by the provider at the providers discretion.

3.4 Cleaner works on behalf of the TNCC on a self—employed basis and is responsible for their own deductions/tax bills owed to HMRC. (You can find more info on the HMRC website to help you with this)

3.5 Cleaner must always be of a very smart appearance when arriving at client’s properties.

Female cleaners: Smart black trousers, heels, with a smart top with hair and make up done to a smart and clean appearance.

Male Cleaners: smart trousers, shirt and formal shoes of a very smart and ciean appearance.

NO JEANS, TRACKSUITS, TRAINERS, HATS OR CAPS TO BE WORN AT ANYTIME. 3.6 The cleaner shall immediately decline and notify the TNCC if required by the client to perform any of the restricted services.

3.7 It is the responsibility of the client to supply the cleaner with cleaning materiais/equipment. The cleaner reserves the right to decline the use of any material/equipment that appears unsafe or poses an immediate danger to the cleaner and shall inform the head office by email clients@tnccservices.co.uk of such a decision.

3.8 The cleaner shall perform their duties and responsibilities in a professional and competent, complete substantially all the work within the days of allocation booking.

Cleaners Conduct

4.1 The cleaner acknowledges that they are providing a Naked, topless, lingerie/outfit requested by the TNCC’s client during the full provision of the service.

4.2 Cleaner acknowledges that the client may either be naked or clothed during the provision of the services at the client’s own discretion.

4.3 Unless otherwise agreed and specifically notified by the TNCC, the cleaner shall not offer cleaning service with more than one person present at the property.

4.4 Client hereby acknowledges that it shall be a breach of this contract to initiate any physical or sexual conduct with the cleaner whether the cleaner has consented or not.

4.5 Similarly, it shall be a criminal offence for a client to have any physical or sexual contact with the cleaner and the client and the cleaner would of signed all the necessary documentation to acknowledge this is a contract for solely a naked, topless, lingerie/outfit cleaning service. Exclusively in case of such an occurrence, the cleaner should leave the premises immediately and notify the TNCC for them to take necessary action against the client.

4.6 Cleaner is additionally under an obligation to leave the clients property immediately if the client is under the influence of alcohol/drugs or starts to partake of the same in the presence of the cleaner. 4.7 The cleaner under no circumstances is to accept any offers of drugs/alcohol and it is a breach of this agreement for the cleaner as part of the services, to serve any of the prohibited substances to the client.

4.8 The cleaner shall not pose for or allow photography by the client during the services. The cleaner shall leave the premises immediately if this occurs.

4.9 The client shall not offer their services direct to the TNCC’s cleaners instead of through TNCC and any attempt to poach our cleaners for direct bookings outside of TNCC. If we find out this has occurred the client is by this agreement, then subject to our poacher’s fee of £2000. Upon signing to our agreements on this document you are accepting you are aware of this payment is legaliy bound.

Cleaners Safety 5.1 Notwithstanding any of the provisions of this clause 5, the cleaners acknowledges that the TNCC has taken all reasonable processes within its means and entered into relevant agreements to ensure the integrity of the clients and therefore shail not be responsible for safeguarding the cleaner whilst working at the clients premises. The cleaner shall remain vigilant and decline to work in any premises that they deem or have any reason to suspect to be unsafe.

That notwithstanding:

5.1.1 For safety reasons the cleaner must email TNCC on arrival to the client’s premises and then again once they have left the premises.

5.2 In case of any hostile behaviour, aggression or alcohol/apcalis drug use the cleaner must leave the property with immediate effect.

5.3 The cleaner shall not disclose any personal information i.e.: Home address, full name and contact number.

5.4 All the communication between the client and cleaner relating to the service should go through TNCC and not directly with the Cleaner.

5.5 TNCC advise cleaners to have a driver i.e. private registered taxi company to take them to the property and collect. This is another scheme to safeguard the cleaners knowing they arrive and leave safely on a logged document. Confidentiality 6.1 The TNCC guarantees to keep the client’s personal information confidential and will not be disclosed to anybody and all details are kept on our computer software only. And we are fully compliant with the GDPR regulations.

6.2 The cleaner’s guarantee to keep the client’s confidential information confidential and should not disclose to anybody other than the law enforcement agency when or if ever required.

Representations and Warranties 7.1 No representation or warranties have been made by the TNCC to the client, other than those expressly stated in this agreement.

Liability 8.1 The TNCC shall not be liable for any loss or damage sustained by the client to their property. In the area where the cleaner is performing their work or handling materials, where that loss or damage is due to cleaner’s own negligence.

8.2 The TNCC shall not be providing the cleaner with a workplace, the cleaner hereby acknowledges that cleaner’s safety and wellbeing should be guaranteed by the client in whose property the cleaner is providing the service for. The cleaner should inform the TNCC immediately when a property becomes hazardous to work in and the TNCC shall notify client immediately and terminate the contract of service.

8.3 The cleaner is not obliged to provide cleaning services in any properties the cleaner regards unfit or unsafe, provided the cleaner shall notify the TNCC of such conditions before refusal to work.

8.4 Cleaner must hold their own public liability insurance up to the value of £1million. This can be completed online for as little as £15pm. Independent Cleaner 9.1 in the performance of the work, duties and obligations in anyway that this is connected with this agreement, it is acknowledged and agreed by the parties that the cleaner shall be and at all time’s is acting and performing as an independent cleaner and should have full control over their provision of services to the client hereunder, the manner in which their services should be carried out provided the cleaner does not breach any of the terms contained in this agreement.

9.2 Further, cleaner is NOT an agent, party, joint venture nor employee of TNCC. Cleaner should have no authority to bind or otherwise obligate TNCC in any manner nor shall cleaner represent to anyone that they have the right to do so.

9.3 Cleaner further agrees that if the TNCC suffers any loss or damage as a result of a violation of the provision cleaner shall indemnify and hold harmless TNCC from any such loss nor damage.

9.4 Cleaner will hold public liability insurance up to £1million.

Entire Agreement 10.1 This agreement contains the entire understanding and agreement between the parties, may not be amended or modified in any respect, except by a subsequent agreement.

Waiver

11.1 No waiver of any provision of this agreement shall be deemed, or shall constitute a waiver of any other provision, whether similar nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by the party making the waiver.

Governing law 12.1 Any disputes concerning the breach of interpretation of any provisions of this agreement shall be governed by the laws of England and Wales. English courts shall have exclusive jurisdiction over all disputes arising. Additional 13.1 The parties acknowledge and agree that:

13.2 The parties are executing this agreement voluntarily and without any pressure or undue influence.

13.3 The parties have carefully read this agreement and have asked any questions needed to understand the terms, consequences, and binding effect of this agreement and fully understand them. 13.4 The parties have sought the advice of an attorney of their respective choice if so desired prior to signing this agreement.

Trading Hours TNCC trading hours for bookings:

Monday-Friday 7am —10pm

(last booking to be at 8pm cleaners to be out of properties at 10pm)

Saturday 7am- 9pm

(last booking to be at 7pm cleaners to be out of properties at 9pm)

Sunday 10 am—4pm

(last booking to be at 2pm cleaners to be out of properties at 4pm)

All cleaners should be out of client’s properties by the end of our business hours and emailed TNCC to clarify shift end.

DECLARATION: THE CLIENT DECLARES HAVING READ AND UNDERSTOOD THE TERMS OF THIS POLICY AND ACCEPTS TO BE LEGALLY BOUND BY THE SAME.

CLEANERS TERMS & CONDITIONS

This agreement is made to the cleaner, (independent contractor). Engaged in Naked, topless and lingerie/outfit domestic cleaning.

AND The naked cleaning company exclusive limited. Office 6, The Loft, Sutton Harbour, Plymouth, PL4—DDN.(Hereinafter referred to as TNCC”).

1. Agreement for services 1. The TNCC wishes to engage the cleaner to provide services of naked, topless and lingerie/outfit domestic cleaning to the TNCC clients.

2. And the cleaner wishes to provide the above services to the TNCC clients.

Now therefore the parties hereto agree as follows: Engagement

1.1 TNCC agrees to engage the cleaner to provide services to the TNCC’S clients upon and subject to the terms and conditions and D85 checks that will need to be carried out hereinafter set forth.

1.2 Cleaner is paid on arrival at the client’s property and must receive payment before carrying out the cleaning service. if client does not settle payment before you must not carry out works and leave property, contact TNCC Immediately.

1.3 TNCC have a very strict over 25 years and above age limit to be able to register as a client/cleaner.

1.4 The cleaner will only attend the registered address of clients on our system.

Term

2.1 The term of the cleaner’s engagement shall commence on a date this agreement is accepted. And to be renewed on a yearly basis at £89.99.Either party may terminate this agreement by providing the other party with written notification at least 14 days, provided that the TNCC may terminate the agreement at anytime and without notice for any breach of our legal clauses within this agreement.

That not—withstanding:

5.1.1 For safety reasons the cleaner must email TNCC on arrival to the client’s premises and then again once they have left the premises.

5.2 in case of any hostile behaviour, aggression or alcohol/drug use the cleaner must leave the property with immediate effect.

5.3 The cleaner shall not disclose any personai information ie: Home address, full name and contact number.

5.4 Gloves to be worn always when using cleaning products.

5.5 All the communication between the client and cleaner relating to the service should go through TNCC and not directly with the Cleaner.

5.6 TNCC advise cleaners to have a driver i.e. A private registered taxi company to take them and collect from client’s properties. 5.7 Cleaners are also advised to wear a safety watch/bracelet or carry a discreet personal alarm. This can be bought online for as little as £8.99.

Time is of the essence

6.1 The cleaner acknowledges that time is of the essence in the performance of all work and non-adherence to allocated time may be a basis for termination of cleaner’s services or non-payment for the service assigned to.

Confidentiality 7.1 The TNCC guarantees to keep the cleaner’s personal information confidential and will not be disclosed to anybody and all details are kept on our computer software only. And we are fully compliant with the GDPR regulations.

10.3 Cleaner further agrees that in the event that the TNCC suffers any loss or damage as a result of a violation of the provision cleaner shall indemnify and hold harmless TNCC from any such loss nor damage.

Entire Agreement 11.1 This agreement contains the entire understanding and agreement between the parties, may not be amended or modified in any respect, except by a subsequent agreement.
